Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Royal Pets ("we," "our," or "us"). By accessing or using Royal Pets, you agree to be bound by these Terms. If you do not agree, do not use the service.

You must be at least 16 years of age to use Royal Pets. By using the service, you represent and warrant that you are at least 16 years old.

Royal Pets is an AI-powered pet portrait studio. You upload a photograph of your dog or cat, and our service uses AI image generation to paint a personalized royal portrait delivered as a high-resolution digital image on a private reveal page.

A commission begins when your payment is confirmed. Your portrait is painted automatically and typically delivered within minutes on your reveal page, from which you can download and share it. The reveal page lives at an unguessable address; anyone you share the link with can view the portrait, so treat the link as you would the file itself.

You must provide a valid email address at checkout. We use it to link the commission to you and to contact you about it. If you sign in, we use email-based one-time password (OTP) authentication, and you are responsible for maintaining access to your email and for all activity that occurs under your account.

Royal Pets offers the following one-time purchase options:

• Noble — $9.99 (the court portrait)
• Royal — $19.99 (the coronation)
• Imperial — $49.99 (the grand commission; limited, by invitation)

All payments are one-time, non-recurring charges processed securely through Stripe. Prices are listed in USD and are subject to change; any changes will not affect previously completed purchases.

If your portrait does not resemble your pet, contact us at vizzo.ai.board@gmail.com and we will repaint it at no charge.

Due to the nature of AI-generated digital content, all purchases are otherwise final and non-refundable. If you experience a verifiable technical failure that prevents delivery of your portrait (e.g., generation failure, corrupted files), contact us at vizzo.ai.board@gmail.com and we will work to resolve the issue or issue a refund at our sole discretion.

No refund is owed where a portrait cannot be painted because the uploaded photograph breaches Section 7 (Photo Requirements and Prohibited Uploads).

You retain ownership of the photographs and details you submit to Royal Pets ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and transmit your User Content solely for the purpose of operating the service — including sending your photo to OpenAI for image generation, storing it so that we can repaint your portrait, and storing results in our systems. We never use your User Content to train AI models.

You are solely responsible for the User Content you upload. By uploading a photograph, you represent and warrant that:

• You own the photograph or hold all rights, licenses, consents, and permissions needed to upload it and to have it used as described in these Terms.
• The photograph does not infringe or misappropriate any copyright, trademark, privacy, publicity, or other right of any person or entity.
• The photograph depicts your own pet, or an animal whose owner has given you permission to have it painted.
• The photograph and its use comply with all applicable laws and regulations.

You alone are accountable for any claim that your User Content infringes the rights of a third party, including any copyright claim. We do not review ownership of uploaded photographs and accept no liability for infringing content you submit. If we receive a complaint about your User Content, we may remove the photograph and any portrait painted from it without notice, and we may share your contact details with the complainant or with authorities where the law requires it.

Royal Pets paints dogs and cats. You agree not to upload, and we will not paint, photographs that:

• Depict people, including faces, bodies, or identifiable body parts, and in particular any image of a minor.
• Contain nudity, sexual or sexually suggestive content, or any other explicit material.
• Show violence, cruelty, injury, or distress to an animal or a person, or are otherwise graphic, hateful, threatening, or harassing.
• Reproduce someone else's creative work, such as artwork, illustrations, stock photography, film stills, logos, or trademarks.
• Were taken from the internet, social media, or another person without the right to use them.
• Are intended to deceive, impersonate, defame, or embarrass any person, or to be used in any unlawful way.
• Violate OpenAI's usage policies or any applicable law.

We may use automated tools and human review to screen uploads and portraits for prohibited content, but we are under no obligation to monitor User Content and cannot guarantee that every prohibited upload will be caught. We may refuse to paint, decline to deliver, or delete any photograph or portrait that we reasonably believe breaches this section, suspend or terminate your access, and report unlawful content to the relevant authorities.

Portraits are generated using artificial intelligence. You receive a personal-use license to your portrait, including the right to download, print, frame, and share it. Regarding AI-generated content:

• AI-generated content may not be perfectly accurate or exactly match your expectations.
• Every portrait is a fresh painting; two commissions from the same photo will not be identical.
• Generated images are subject to OpenAI's usage policies and content restrictions.
• We reserve the right to refuse generation of content that violates our acceptable use policy or OpenAI's policies.
• You are solely responsible for how you use, publish, print, or share your portrait, and you agree not to present it as a hand-painted work or as endorsed by any person or brand.

The Royal Pets name, logo, branding, website design, user interface, portrait styles, and underlying source code are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary materials beyond what is necessary to use the service as intended.

You agree not to:

• Use the service to generate harmful, illegal, defamatory, obscene, or offensive content.
• Upload any photograph that breaches Section 6 (User Content and License) or Section 7 (Photo Requirements and Prohibited Uploads).
• Attempt to reverse-engineer, decompile, or disassemble any part of the service.
• Exploit vulnerabilities, circumvent security measures, or interfere with the operation of the service.
• Share your account credentials or allow unauthorized access to your account.
• Use automated tools, bots, or scrapers to access the service in a manner that exceeds normal usage.
• Resell, redistribute, or commercially exploit generated content without authorization.
• Use the service in any manner that violates applicable laws or regulations.

ROYAL PETS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROYAL PETS, ITS OWNERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Royal Pets, its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your User Content, including any claim that a photograph you uploaded infringes a copyright, trademark, privacy, publicity, or other right; (c) any portrait painted from your User Content and your use of it; (d) your violation of these Terms; or (e) your violation of any rights of a third party.

Informal Resolution: Before filing any formal proceeding, you agree to contact us at vizzo.ai.board@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions or class-wide arbitration.

We reserve the right to refuse service, or to suspend or terminate your account, at our sole discretion if you violate these Terms or engage in activity that harms the service or other users. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.

You may request deletion of your photo, portrait, or account at any time by contacting us at vizzo.ai.board@gmail.com. Deletion is subject to the data retention terms described in our Privacy Policy.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Royal Pets regarding the use of the service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the service.

These Terms shall be governed by and construed in accordance with applicable law. To the extent litigation is permitted under these Terms, you consent to the jurisdiction of a court of competent jurisdiction.
